Ombudsman appealed to ICRC on detained Azerbaijani citizen in Armenia

The Commissioner for Human Rights (Ombudsman) of the Republic of Azerbaijan Elmira Suleymanova appealed to International Committee of the Red Cross, Ombudsman Apparatus told ONA.

The resident of Yukhari Salahli village of Gazakh region of Azerbaijan, Ibrahimov Elvin Arif oglu, born in 1986, currently held captive in Armenia. Elvin Ibrahimov, a II group disabled person, who is registered in the Gazakh interregional mental hospital and has repeatedly been treated.

According to his mother, her son left home for the work on March 15 and while he got lost his way in Gazakh on  borderline with Noyemberyan region of the Armenian Republic passing the borderline was wounded with the shot fire opened by Armenian soldiers:

“According to the Article 3 of the  Geneva Convention 1949 on the Protection of Civilians during the war, civilians who are not directly involved in combat operations are prohibited from taking hostages and should be returned to their country  promptly.”

At the same time, based on the 16 Article of the mentioned Convention he should be surrounded with special care and protection and should be freed from hostage soon taking into consideration that E. Ibrahimov is II group disabled person and he was wounded by Armenian soldiers while mistakenly crossing the border

However, it should be noted with regret that Armenian side, as always, violated the norms and principles of international law, took the civilian hostage. Despite his disability, Armenia has not taken any measures to return him back to his country soon.

Taking into account the international norms and the appeal letter of E. Ibrahimov’s mother to Ombudsman of Azerbaijan the Commissioner Elmira Suleymanova has addressed to the head of the International Committee of the Red Cross in Azerbaijan Elena Ajmone Sessera.

On the appeal it is requested to ensure E. Ibrahimov is not subjected to any physical or mental abuse during his captivity, control of his health and general condition through the representative offices in the country of detention as well as to assist to return him back to Azerbaijan as soon as possible within the framework of the mandate of the Commission.
